National Green Tribunal bans brick kilns in NCR during monsoon season

A plea has been appealed by the National Green Tribunal (NGT) seeking a review of its order of banning the operations of coal-fired brick kilns in the NCR during the monsoons beyond June.

The green panel told the media that if a case has been concluded after full consideration of arguments made by the counsel, then even under the garb of doing substantial justice or justice, he cannot be allowed to engage the court to decide the controversy that has already been decided again.

The NGT bench told the media that if a party is aggrieved of a judgment, it should approach the higher court but entertaining a review to reconsider the case would lead to exceeding its jurisdiction, discussed under the limited jurisdiction for the purpose of review.

Additionally, the tribunal also said that they do not think it proper to interfere in this matter and that the review application is devoid of any merit and not maintainable.

The tribunal was hearing an appeal by some brick kiln owners saying that they can be allowed to operate during the time of July-September, which are monsoon months, and there is no option to exclude this period.

They claimed that if the air quality is carrying capacity and within the norms, the 'zig-zag type brick kilns can be allowed as suggested by the Central Pollution Control Board as there is the supportive or assimilative capacity to support these operations.
