SC issues notice to demolish Supertech twin towers in Noida

The Supreme Court's order to demolish Supertech's twin towers in Noida was hailed by homebuyers' group FPCE on Tuesday, who said the decision would deter both builders and development authorities from wrongdoing.
The Forum for People's Collective Efforts (FPCE) was instrumental in the passage and implementation of the Real Estate Reform Act (RERA) in all 50 states.
The Supreme Court on Tuesday ordered the demolition of twin 40-storey towers in Supertech Ltd's Emerald Court project in Noida for violating building by-laws in collusion with authority officials, dealing a blow to the real estate giant. Apex and Ceyane, two towers of Supertech's Emerald Court Project in Sector 93, have a total of 915 apartments and 21 shops.
The apex court also ordered that home buyers' deposits be refunded with 12% interest from the time of booking and that the Residents Welfare Association be compensated with Rs 2 crore for the harassment caused by the twin towers' construction.

The Rs 2 crore compensation awarded to the Resident Welfare Association is also unprecedented, and it will undoubtedly encourage and motivate others to pursue legal action against builders for any wrongdoing involving common areas, as well as missing facilities and amenities.
The judgement, according to Nishit Dhruva, Managing Partner, MDP and Partners, Lawyers and Solicitors, is a wake-up call for builders not to act on sanctioned plans that are shrouded in suspicion, as well as for planning authorities to maintain the integrity attached to their office.
